1) Who We Are
[Canadian Druze Society of Ontario – Ottawa Chapter] (the “Organization,” “we,” “us,” or “our”) is a not‑for‑profit community organization based in Ontario, Canada. Our website located at [https://www.druze.ca] (the “Site”) provides information about our committees, programs, events, volunteer opportunities, membership, and donation options.
2) Acceptance of These Terms
By accessing or using the Site, creating an account, registering for events, donating, purchasing merchandise, or otherwise interacting with the Site (collectively, the “Services”), you agree to be bound by these Website Terms & Conditions (the “Terms”) and all policies referenced here (e.g., our Privacy Policy, Code of Conduct, Cookie Notice, and Refund Policy). If you do not agree, do not use the Services.
If you are using the Services on behalf of an organization, you represent and warrant that you have authority to bind that organization, and “you” refers to that organization.
3) Eligibility & Geographic Scope
The Services are intended for individuals who can form legally binding contracts under applicable law. You may use the Services only in compliance with these Terms and all laws that apply to you. Our primary place of business is in Ontario, Canada, and we operate the Site from Ontario. Content may not be appropriate or available in other jurisdictions.
4) Changes to the Terms or Services
We may modify these Terms or any part of the Services at any time. Material changes will be highlighted on this page and/or communicated by email (if you maintain an account or subscription). Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms. We may suspend, discontinue, or restrict portions of the Services without notice.
5) Accounts, Passwords & Security
Certain features require an account. You agree to:

keep your login credentials confidential and secure.
You are responsible for activities under your account. Notify us immediately of any unauthorized use. We may refuse registration, close accounts, or reclaim usernames at our discretion.
6) Community Standards & Code of Conduct
We foster a welcoming, inclusive community. By using our Services or participating in events/online spaces (forums, chat, social media), you agree to:

treat others with respect and dignity;

refrain from harassment, hate speech, bullying, threats, or discrimination based on protected characteristics;

avoid promoting violence or illegal activity; and

follow the direction of our staff and volunteers at events.
We may remove content, suspend access, or take other appropriate action if we believe conduct violates these standards or applicable law.
7) Donations, Tax Receipts & Recurring Gifts
Donation processing. Donations may be processed directly on our Site or through third‑party platforms (e.g., [CanadaHelps], [Stripe], [PayPal]). Third‑party terms and privacy practices apply to those transactions.
Tax receipts. If we are a registered charity in Canada, we issue official donation receipts for eligible gifts in accordance with Canada Revenue Agency (CRA) requirements. To issue receipts, donors must provide accurate legal name and mailing/email address. If we are not a registered charity, we cannot issue official donation receipts for income tax purposes.
Recurring donations. If you enroll in monthly or recurring donations, you authorize us (or our processor) to automatically charge your selected payment method at the stated interval and amount until you cancel. You may modify or cancel at any time by [logging into your donor account/contacting us]. Changes may take one billing cycle to take effect.
Refunds of donations. As a general policy, charitable gifts are non‑refundable. If you believe there has been an error (duplicate charge, incorrect amount, fraud), please contact us at [reachus@druze.ca] within [30] days and we will review the request in good faith.
8) Membership (If Applicable)
If the Organization offers membership:

Eligibility & dues. Membership categories, eligibility, and dues (if any) are described on the Site. Dues are non‑transferable and non‑refundable unless stated otherwise.

Term. Membership typically runs for [12 months/calendar year] unless otherwise specified. We may change benefits, categories, or fees from time to time.

Discipline. We may suspend or terminate membership for breach of these Terms, our Code of Conduct, or applicable bylaws. Membership does not confer ownership or distribution rights over Organization assets.
9) Events, Programs & Ticketing

Registration. By registering, you confirm the accuracy of your information and agree to any event‑specific rules. Some events may have age or capacity limits.

Payments & fees. Prices are in Canadian dollars (CAD) unless noted. Taxes and processing fees may apply. All sales are final unless our Event Policy states otherwise.

Cancellations & changes. We may modify event programs, speakers, schedules, locations, or cancel events. If we cancel a paid event, we will offer a refund or credit. We are not responsible for travel or other third‑party costs.

Assumption of risk. Participation in activities may involve inherent risks. By attending, you accept those risks to the extent permitted by law.

Photo/video. Events may be photographed, recorded, or live‑streamed. By entering, you consent to the use of your image, voice, and likeness for non‑commercial, educational, and promotional purposes without compensation. If you prefer not to be photographed, please inform an event organizer on site.
10) Merchandise & E‑commerce (If Applicable)

Orders & acceptance. Placing an order is an offer. We may accept or decline. If accepted, we will confirm by email.

Pricing & availability. We strive for accuracy but errors may occur. We may correct errors and cancel orders before shipment.

Taxes & shipping. Prices exclude shipping and applicable taxes unless stated. Risk of loss passes on delivery to the carrier.

Returns. Returns are accepted within [30] days for unused items in original condition with proof of purchase, except final sale items. Refunds are to original payment method.
11) Acceptable Use & Prohibited Activities
You agree not to:

violate laws or infringe rights (IP, privacy, publicity);

post or transmit harmful content (malware, spam, defamation, obscene or hateful material);

attempt to access accounts, systems, or data without authorization;

interfere with or disrupt the Site’s operation or security;

use automated means (scraping, bots) without our prior written permission; or
-
misrepresent your identity or affiliation.
12) Intellectual Property & Your Content
Our IP. The Site, including text, graphics, logos, photos, videos, designs, and software, is owned by the Organization or our licensors and protected by Canadian and international laws. We grant you a personal, revocable, non‑exclusive, non‑transferable license to access and use the Site for lawful, non‑commercial purposes.
Your content. If you submit content (e.g., comments, testimonials, photos), you represent that you own or have rights to it and it does not infringe others’ rights. You grant the Organization a worldwide, royalty‑free, perpetual, irrevocable, non‑exclusive license to use, reproduce, modify, adapt, publish, translate, distribute, perform, and display such content in any media for our mission‑related purposes. Where permitted by law, you waive moral rights in such content in favour of the Organization.
Trademarks. Our name and logos are trademarks of the Organization. Other names and logos may be trademarks of their respective owners. No rights are granted to use any trademark without written permission.
13) Third‑Party Services & Links
The Services may link to or integrate with third‑party websites and services (e.g., payment processors, fundraising, ticketing, video platforms). We do not control and are not responsible for third‑party content, policies, or practices. Your use of third‑party services is at your own risk and subject to their terms and privacy policies.
14) Privacy, Cookies & Email Consent
Please review our Privacy Policy for information on how we collect, use, disclose, and safeguard personal information.
Cookies & analytics. We use cookies and similar technologies for functionality and analytics. You may adjust browser settings to block cookies, which may affect Site functionality. See our Cookie Notice for details.
Canadian Anti‑Spam Legislation (CASL). By providing your email address, you consent to receive emails from us about programs, events, and updates, subject to your right to unsubscribe at any time. We also rely on implied consent in circumstances permitted by CASL.

16) Disclaimers (No Professional Advice)
The Site is provided for general informational and educational purposes only. We do not provide legal, medical, financial, or professional advice. Content is provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including warranties of accuracy, fitness for a particular purpose, non‑infringement, or availability.
17) Limitation of Liability
To the fullest extent permitted by law, the Organization and its directors, officers, employees, and volunteers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; or for loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Services.
Where liability cannot be excluded under applicable law, our aggregate liability to you for all claims relating to the Services will not exceed the greater of: (a) CAD $100; or (b) the total amount you paid to us for the specific Service giving rise to the claim during the 12 months preceding the event giving rise to liability.
Nothing in these Terms limits liability for gross negligence, intentional misconduct, or injury where such limitation is prohibited by law.
18) Indemnification
You agree to defend, indemnify, and hold harmless the Organization and its directors, officers, employees, and volunteers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Services; (b) your content; (c) your violation of these Terms; or (d) your violation of any rights of another.
19) Copyright & Notice‑and‑Notice (Canada)
We respect intellectual property rights. If you believe that content on the Site infringes your copyright, please send a notice to [reachus@druze.ca] with:

identification of the copyrighted work;

identification of the allegedly infringing material and its location on the Site; and

a statement that you have a good‑faith belief the use is not authorized.
Canada’s notice‑and‑notice regime may apply. We may forward notices to users and, where appropriate, remove or disable access to content.
20) Termination & Suspension
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, provisions that by their nature should survive (e.g., ownership, licenses, disclaimers, limitations of liability, indemnity) shall survive.
21) Governing Law & Dispute Resolution
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws principles. You agree to the exclusive jurisdiction and venue of the courts located in Ontario, Canada (and, for small claims, any Ontario Small Claims Court with jurisdiction) unless arbitration is mutually agreed.
Before filing a claim, the parties will attempt to resolve the dispute informally in good faith within 30 days of written notice. Nothing prevents a party from seeking injunctive or equitable relief for urgent matters.
22) International Use
We make no representation that the Services are appropriate or available outside Canada. If you access the Services from other jurisdictions, you do so at your own initiative and are responsible for compliance with local laws.
23) Force Majeure
We are not liable for any delay or failure to perform due to causes beyond our reasonable control, including acts of God, natural disasters, epidemics, labour disputes, network failures, or government actions.
24) Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a reorganization or transfer of activities.
25) Entire Agreement; Severability; Waiver
These Terms, together with policies referenced herein, constitute the entire agreement between you and the Organization regarding the Services and supersede prior agreements. If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will remain in full force. Our failure to enforce any right is not a waiver of such right.
